 TERMS & CONDITIONS – GOLD COAST CHRISTMAS TREES (GCCT)

Welcome to Gold Coast Christmas Trees (“GCCT”). By placing an order, visiting our website or using our services, you agree to the following Terms & Conditions. Please read them carefully.

1. Introduction

1.1 GCCT is operated by MACJ Holdings Pty Ltd ABN  61488699267.
1.2 These Terms & Conditions govern all orders, deliveries, collections, installations, removals, and all interactions relating to our products and services.
1.3 By using our website or placing an order, you accept these terms.

2. Products & Quality

2.1 GCCT supplies real, natural Christmas trees, a living agricultural product that can vary in shape, size, density, fragrance and appearance.
2.2 Needle drop is normal and expected, especially during transport, set-up and throughout the Christmas period.
2.3 Tree photos on the website are examples only. Actual trees will vary.
2.4 We do not guarantee exact dimensions, but trees are supplied within their stated height category.

3. Pricing & Payment

3.1 All prices on our website are in AUD and include GST unless stated otherwise.
3.2 Payment must be made in full at the time of ordering unless an alternative arrangement is explicitly agreed to by GCCT.
3.3 Additional fees may apply for:

  • Delivery outside standard areas

  • Installation and decoration

  • Collection/removal in January

  • Special access requirements (stairs, long carry, restricted parking)

4. Delivery & Collection

4.1 Delivery dates and time windows are approximate.
4.2 Due to seasonal demand, weather, traffic and supplier schedules, delays may occur. We will always attempt to notify customers of changes.
4.3 If no one is home, our team will place the tree in a safe accessible location at their discretion.
4.4 Customers are responsible for ensuring clear access for delivery and removal.
4.5 If access is unsafe or obstructed, GCCT may refuse delivery or charge an additional fee.

5. Installation & Decoration (Gold Service)

5.1 Gold Service includes delivery, installation, decoration and January removal.
5.2 Decoration colour themes and styles are subject to stock availability.
5.3 GCCT reserves the right to use alternative decorations of similar style if needed.

6. Refunds, Returns & Exchanges

6.1 As real Christmas trees are perishable and individually unique, all sales are final.
6.2 Refunds are not provided for:

  • Minor variations in shape or fullness

  • Needle drop

  • Customer preference

  • Environmental or weather-related effects
    6.3 If your tree arrives in unacceptable condition (rare), you must notify us within 24 hours, including photos, so we can assess replacement eligibility.

7. Customer Responsibilities

7.1 Customers must:

  • Keep the tree stand filled with water

  • Avoid placing trees near heat sources

  • Follow any care instructions provided
    7.2 GCCT is not responsible for tree deterioration resulting from lack of water or improper care.

8. Liability

8.1 To the maximum extent permitted by law, GCCT is not liable for:

  • Accidental damage caused during customer handling

  • Tree-related staining, sap marks, or water damage

  • Allergic reactions

  • Decorations provided by customers

  • Any indirect or consequential loss
    8.2 Our liability is limited to the value of the product purchased.

9. Changes to Orders

9.1 Order changes (size, date, delivery address) must be requested at least 48 hours before scheduled delivery.
9.2 GCCT may not be able to accommodate late changes.

10. Website Use

10.1 All website content including photos, text and branding is owned by GCCT.
10.2 You may not copy or reproduce any content without permission.

11. Privacy Policy & Use of Customer Information

11.1 Collection of Information

We collect personal information including your name, phone number, email, delivery address, order history and preferences to process orders and communicate with you.

11.2 Use for Marketing & Communication

By providing your details, you consent to GCCT contacting you about:

  • Christmas tree orders and updates

  • Promotions, special offers and marketing

  • New products or services

  • Any future businesses, brands or ventures operated by GCCT’s current owner or related entities

11.3 Use by Future or Related Businesses

You consent to your personal information being used by:

  • GCCT

  • The current owner of GCCT (Mark Cameron / MACJ Holdings Pty Ltd)

  • Any future businesses or services established or operated by the current owner or their related entities

  • Any entity that acquires GCCT (limited to Christmas-tree-related communications)

11.4 Retention of Customer List by Current Owner

If GCCT is sold, merged or transferred:

  • Customer information may be transferred to the new owner

  • The current owner may retain a copy of the customer list for the purpose of operating non-competing future businesses and may communicate with you about those services unless you opt out

11.5 Opt-Out

You may unsubscribe at any time by:

  • Clicking the “unsubscribe” link in emails

  • Replying STOP to SMS

  • Contacting us directly

Your request will be respected promptly.

11.6 Data Security

We take reasonable steps to secure customer information from misuse, interference, unauthorised access or disclosure.

12. Changes to Terms & Conditions

GCCT may update these Terms & Conditions at any time. Changes will be published on this page.

Promotional Vouchers & Giveaways – $500 Christmas Tree Voucher

$500 Christmas Tree Voucher Promotion

From time to time, Gold Coast Christmas Trees (“GCCT”) may offer promotional vouchers and giveaways, including a $500 Christmas Tree Voucher (“Voucher”).

Eligibility

  1. Entry is only open to customers who have purchased a real Christmas tree from GCCT during the current Christmas season.

  2. To be eligible, customers must have:

    • Completed a qualifying purchase, and

    • Left a genuine Google review for Gold Coast Christmas Trees during the promotional period.

  3. Only one entry per customer is permitted, regardless of the number of trees purchased.

Draw Details

  1. The Voucher winner will be selected at random from all eligible entries.

  2. The draw will take place on 21 December 2025.

  3. The winner will be notified on 23 December 2025 via text message or email, using the contact details provided at the time of purchase or review.

Voucher Conditions

  1. The Voucher is valid for one future Christmas season only, typically the following year after issue.

  2. The Voucher is not redeemable for cash, not transferable, and cannot be exchanged, refunded, or substituted.

  3. Only one Voucher may be used per order.

  4. The Voucher may be redeemed against the purchase of:

    • A real Christmas tree, and/or

    • GCCT Christmas tree services,
      as specified in the promotional material.

  5. The Voucher cannot be used in conjunction with any other offer, discount, or promotion, unless expressly stated.

  6. If the total order value is less than the Voucher value, no credit or balance will be carried forward.

  7. The Voucher must be redeemed by the expiry date stated in the promotion. Expired Vouchers will not be honoured.

General

  1. GCCT reserves the right to verify eligibility, including proof of purchase and confirmation of the Google review.

  2. Lost, stolen, damaged, or deleted Vouchers will not be replaced.

  3. GCCT reserves the right to withdraw, vary, or cancel the promotion where reasonably necessary, including in cases of fraud, misuse, or unforeseen circumstances.

Participation in this promotion constitutes acceptance of these Terms & Conditions.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (ACL). Gold Coast Christmas Trees complies with all applicable Queensland consumer protection and privacy laws.
